Ohio Lawmakers Move to Regulate Intoxicating Hemp Products

Ohio lawmakers are working on a permanent fix for the sale of intoxicating hemp products, like delta-8 THC, which can currently be sold unregulated in the state.

A temporary restraining order blocking Gov. Mike DeWine’s ban on the products expires December 2, leaving the legality in question until the Franklin County Court of Common Pleas rules.

Ohio House Speaker Matt Huffman says lawmakers hope to reach a compromise before Thanksgiving, with both chambers agreeing on age restrictions and safety testing. Differences remain over where products can be sold: the Senate wants sales limited to recreational marijuana dispensaries, while the House favors a new hemp licensing system.

Lawmakers are also considering updates to the state’s recreational marijuana law, including public smoking bans and an expungement process for low-level offenses. One key point is the allocation of marijuana tax revenue, with the House supporting giving 36% to local host communities.

Huffman says the goal is to settle both hemp and marijuana regulations and ensure local communities receive tax revenue generated from dispensaries.
